3. Online Ordering and Purchases

When you place an order through our Services, you are making an offer to purchase the selected products. All orders are subject to availability and acceptance by Star Burger. We reserve the right to refuse or cancel any order for any reason, including but not limited to product unavailability, errors in product or pricing information, or suspected fraudulent activity.

3.2  Pricing and Menu

Menu items, descriptions, and prices are subject to change without notice. Prices displayed are in U.S. Dollars and do not include applicable taxes, delivery fees, or service charges, which will be itemized during checkout. Star Burger makes every effort to ensure accuracy but is not responsible for typographical or pricing errors.

3.3  Payment

We accept major credit and debit cards, and other payment methods as made available at checkout. By submitting payment information, you authorize Star Burger (or our third-party payment processor) to charge the total order amount to your designated payment method. All transactions are encrypted and processed securely. Star Burger does not store full payment card details on its servers.

3.4  Order Confirmation

An order confirmation sent to your email or displayed on screen does not constitute formal acceptance of your order. Acceptance occurs when your order is prepared and dispatched or made available for pickup. We will notify you if we are unable to fulfill your order.

3.5  Cancellations and Modifications

Due to the perishable nature of food products, orders may not be cancelled or modified once they have entered preparation. If you need to cancel an order, please contact us immediately at contact@starburger.com and we will make every reasonable effort to accommodate your request before preparation begins.

Estimated delivery times are provided as a courtesy and are not guaranteed. Delivery availability, fees, and minimum order amounts may vary by location. Star Burger is not liable for delays caused by circumstances beyond our reasonable control, including traffic, weather, or third-party delivery partners.

3.7  Food Allergies and Dietary Information

While we take care to provide accurate menu and ingredient information, our kitchen handles common allergens including gluten, dairy, eggs, peanuts, tree nuts, soy, and shellfish. We cannot guarantee that any menu item is completely free from allergens. If you have a severe food allergy, please contact us directly before placing your order. Star Burger is not liable for adverse reactions resulting from undisclosed allergen sensitivities.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN ALL CASES, OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

12.4  Class Action Waiver

YOU AND STAR BURGER EACH AGREE THAT ANY CLAIMS AGAINST THE OTHER MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. NEITHER YOU NOR STAR BURGER MAY JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER USERS.
